1. Acceptance of terms

Alex Truck Tire operates as a provider of:

• Commercial truck tires and related products
• Installation, alignment, brake, and suspension services
• Third-party financing facilitation

All services are subject to availability and may be modified or discontinued without notice.

3. Compliance with applicable laws

Our operations are conducted in accordance with applicable laws, including but not limited to:

• Florida Deceptive and Unfair Trade Practices Act (FDUTPA) – governing fair business practices
• Florida Motor Vehicle Repair Act (F.S. §559.901–559.9221) – where applicable to repair-related services
• Uniform Commercial Code (UCC Article 2) – governing sale of goods
• Federal Trade Commission Act (FTC Act) – prohibiting deceptive or misleading advertising

Nothing in these Terms creates additional legal obligations beyond those required by law.

4. No guarantee of results

Due to the mechanical nature of vehicles:

• No specific performance outcomes are guaranteed
• Tire wear, alignment results, and braking performance may vary
• Pre-existing or undisclosed issues may affect service outcomes

Customer acknowledges and accepts these inherent risks.

5. Vehicle condition & customer responsibility

By requesting service, the customer confirms:

• The vehicle is safe for inspection and service
• All known issues have been disclosed
• The Company is not responsible for hidden, latent, or pre-existing defects

6. Limitation of liability

To the maximum extent permitted by Florida law:

• Alex Truck Tire shall NOT be liable for indirect, incidental, or consequential damages
• We are NOT responsible for accidents, mechanical failures, or damages occurring after service
• Total liability shall NOT exceed the amount paid for the specific service or product

Use of all products and services is at customer's own risk.

7. Disclaimers of warranties

To the fullest extent permitted under the Uniform Commercial Code (UCC), all products are provided "AS IS" unless otherwise stated. We disclaim all implied warranties, including:

• Merchantability
• Fitness for a particular purpose

Any applicable warranties are provided solely by the manufacturer.

8. No refund policy

• All installed products are FINAL SALE
• Labor and service charges are NON-REFUNDABLE
• Warranty claims must be processed directly with the manufacturer

9. Pricing & errors

• Prices are subject to change without notice
• We reserve the right to correct pricing or typographical errors
• Quotes are estimates and not binding unless confirmed in writing

10. Payment terms

• Payment is due upon completion of service unless otherwise agreed
• We reserve the right to refuse or withhold service for non-payment
• Additional charges may apply for unforeseen conditions discovered during service

11. Third-party financing disclaimer

We may assist customers in accessing financing options. However:

• We are NOT a lender
• We do NOT guarantee approval
• All financing terms are controlled by third-party providers

Customer agrees to hold Alex Truck Tire harmless from any financing-related disputes.

12. Website use

You agree NOT to:

• Use the website for unlawful purposes
• Attempt unauthorized access, hacking, or data scraping
• Provide false or misleading information

We reserve the right to restrict access at our discretion.

13. Intellectual property & trademarks

• All website content is the property of Alex Truck Tire
• Third-party brand names (e.g., tire manufacturers) are the property of their respective owners
• Use of such names does not imply endorsement unless explicitly stated

14. Indemnification

You agree to indemnify and hold harmless Alex Truck Tire from any claims, damages, or liabilities arising from:

• Failure to maintain the vehicle
• Violation of these Terms

15. Force majeure

We are not liable for delays or failure to perform due to events beyond our control, including:

• Natural disasters
• Supply chain disruptions
• Labor shortages

16. Governing law & jurisdiction

These Terms shall be governed by the laws of the State of Florida. Any disputes shall be resolved exclusively in Miami-Dade County, Florida.

17. Dispute resolution

At our discretion, disputes may be resolved through binding arbitration instead of court litigation.

18. Modifications

We reserve the right to modify these Terms at any time. Continued use of our services constitutes acceptance of updated Terms.

19. Entire agreement

These Terms constitute the entire agreement between the customer and Alex Truck Tire regarding services and website use.
